agree to these terms, use the web site or purchase goods available
over the web site. You may only purchase the goods available from
this site if you are resident in the Countries accepted by us. |

We may modify these terms at any time. We will post the modified
terms on the web site. The modified terms will come into effect
as soon as they are posted on the web site and use of the web site
and purchases of any goods from the web site after that point will
be subject to the modified terms. |
2.1 |
You may open an account with Beresfords by completing the Registration
Form or ordering items from us. Once your registration has been
accepted (and until your account is terminated) you will be allowed
to (subject to these terms) offer to purchase goods available from
this site from us. |

You will have to give your e-mail address in order to open an
account. Your e-mail address will help us to verify your identity
in future visits. In the event that you register using a non-existent
e-mail address or an e-mail address that belongs to someone else,
we may terminate your account without further notice. |

There is no charge for opening a Beresfords account. |
2.4 |
There are charges for goods supplied by us. Subject
to clause 3.2, prices are displayed on the site and will be notified
to you when you request the goods. When you place an order for goods
you will need to give your credit card number. The charges for the
goods will be billed to your credit card once your order is accepted.

In the event that you give details of a non-existent credit card
number or the number of a credit card that belongs to someone else,
your order will not be processed and we reserve the right to terminate
your account without notice. |
3.1 |
We may accept or decline orders at our discretion and we are
not bound to accept any order. |

All prices are subject to change at any time without notice.
In the event of any such change, we will take all reasonable steps
to inform you prior to order of your goods. |
3.3 |
In the event of unavailability of any item we will take all reasonable
steps to inform you and offer an alternative item prior to despatch
of your order. If you do not want the alternative item, we will
not process your payment or will refund any payment already made.

We will despatch your order by recorded delivery or Special Delivery.
Heavy items are dispatched via courier. Please allow 3 working days
for delivery in the UK. Delivery costs and VAT are not included
in the prices quoted.These are added at "checkout" If any other
method of delivery is requested there may be an extra cost. Heavy
items may incur an extra shipping cost for shipment outside the
UK. |

All intellectual property rights, including copyright, in the
site design, text, graphics and other content, interfaces, and the
selection and arrangement of these belong to us or our licensors.
You may electronically copy and print hard copy portions of this
site for the sole purpose of placing an order with us or using this
site as a shopping resource. Any other use of materials on this
site is not permitted. |

We warrant that our products will be of satisfactory quality
and conform with any description attributed to them and in accordance
with law. Nothing in these terms shall be taken to exclude or restrict
any rights which applicable law grants to consumers in respect of
such products or services. If there is any breach of this warranty
or you are otherwise not satisfied with the delivered goods, you
may return then to us within 10 days of delivery to you and we will
arrange a replacement or refund and will reimburse any postage costs
incurred. |

Except as set out in these terms, there are no other warranties,
conditions or other terms, express or implied, statutory or otherwise,
and all such terms are hereby excluded to the maximum extent permitted
by law. |
6.4 |
Except as set out in clause 6.3, we do not accept any liability
for any indirect or consequential loss, howsoever arising, and even
if we have previously been advised of the possibility of such loss.

You may terminate your account by contacting us via e-mail or
post. You may be asked to provide further proof that you are the
holder of the account. Your account will be terminated as soon as
reasonably practicable following receipt of your e-mail or letter.

We may terminate your account without notice at our sole discretion.

You may cancel any order provided that you return the goods to
us, by recorded delivery, unused and in the condition supplied by
us, within 10 days of delivery to you. We will refund any payment
made as soon as reasonably practicable |
8.1 |
Shipping Cuban cigars to the US is undertaken by us. We accept
no liability for any loss or confiscation by US customs. |

us are governed by and to be interpreted in accordance with the
English law. In the event of any dispute arising in relation to
these terms or in relation to the supply of any good or services
by us the English courts will have exclusive jurisdiction over such
dispute. |
